Terms of Use

These terms apply to the app Sport Unlock (the "app") and form the licence agreement (EULA) between you and the provider. By downloading or using the app, you agree to them.
1. Provider

2. Who your contract is with
These terms are between you and the provider, not between you and Apple Inc. ("Apple"). The provider, not Apple, is solely responsible for the app and its content.
You buy the subscription through the App Store from Apple. Apple’s terms therefore govern purchase, payment, withdrawal and refunds, and these terms govern your use of the app.

3. Licence
You receive a limited, non-transferable licence to use Sport Unlock on Apple-branded devices that you own or control, as permitted by Apple’s Usage Rules, including Family Sharing where it is available for the subscription. Features that require a subscription are available for as long as it is active.
You may not rent, resell, modify, reverse engineer or create derivative works of the app, except where the law expressly allows it.
4. Subscription
The app is offered through an auto-renewing subscription (Sport Unlock Pro). The App Store shows you the price, the period and any free trial before you subscribe.
Payment is charged to your Apple ID when you confirm the purchase or, if you start with a free trial, when the trial ends. The subscription renews automatically for the same period unless you cancel at least 24 hours before it ends. The renewal is charged within 24 hours before the end of the current period.

5. Health
The app asks you to do physical exercise, such as push-ups. It is not a medical device and does not replace medical advice.
Only exercise if your health allows it. Keep your form clean, make sure you have enough space and a safe surface, and stop if something hurts. If you have a medical condition, an injury or are pregnant, talk to a doctor first.
6. Limits of the app
The app counts reps automatically with the camera. That does not always work: light, camera angle, distance, clothing or the way you move can cause reps to be counted too many, too few or not at all. The provider gives no guarantee that the count is correct.
The app blocks the apps you choose through Apple’s Screen Time until you have done your reps. Whether and how reliably that works is up to iOS. The block is not a security or parental control tool.
Do not block apps you need right away in an emergency. Emergency SOS on iOS works independently of the app.
The app is a tool for your habits. Do not rely on it alone for anything important.
7. Maintenance and support
The provider alone is responsible for maintenance and support of the app, as set out in these terms and required by applicable law. Apple has no obligation whatsoever to provide any maintenance or support services for the app.
8. Updates and changes
The provider supplies the updates needed for the app to keep working as described, for example after changes to iOS. If you do not install them, the app may no longer be able to do its job.
The provider may develop the app further and change features if there is a valid reason. If this makes the app more than slightly worse for you, you will be told in good time beforehand and can end the subscription. Your statutory rights remain unaffected.
9. Warranty
Your statutory warranty rights apply.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if you paid one. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are the sole responsibility of the provider.
10. Liability
The provider is liable without limit for intent and gross negligence and for injury to life, body and health caused by the provider’s fault.
For slight negligence, the provider is only liable for breach of an essential contractual obligation, meaning one without which the app could not be used as agreed at all. Liability is then limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
This means that for the consequences of a wrong count, an app being blocked or not blocked, or the app being temporarily unavailable, such as missed messages, calls or appointments or lost income, the provider is only liable under the two paragraphs above.
You do the exercises at your own risk. The provider is only liable for injuries during training if the provider caused them through their own fault.
Mandatory consumer rights, for example under the Austrian Consumer Protection Act or the Product Liability Act, remain unaffected.
11. Claims relating to the app
The provider, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it. This includes in particular product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
If a third party claims that the app or your possession and use of it infringes their intellectual property rights, the provider, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
12. Export control
You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
13. Third-party terms
When you use the app, you must comply with any third-party terms that apply, such as those of your mobile carrier.
14. Apple as third-party beneficiary
Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

16. Changes to these terms
The current version is always on this page, and the date above tells you when it last changed. A subscription you have already taken out stays under the version that applied when you subscribed, unless you agree to a new one.
17. Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. As a consumer, you keep the protection of the mandatory provisions of the country where you habitually live, and you can bring proceedings there.
If any provision of these terms is invalid, the rest remain in effect.
